In Scotland, stamp duty has been replaced by the Land and Buildings Transaction Tax (LBTT). This is a property tax paid when you buy a home or piece of land over a certain price. The amount depends on the purchase price and whether you already own another property.
Your solicitor will calculate the correct amount and submit the LBTT return to Revenue Scotland on your behalf as part of the conveyancing process.
You should have buildings insurance in place from the date of entry, as responsibility for the property passes to you that day.
The Additional Dwelling Supplement (ADS) is an extra tax that applies if you buy a second property in Scotland – for example, a buy-to-let or a holiday home.
It’s charged at 6% of the total purchase price and is paid on top of the standard Land and Buildings Transaction Tax (LBTT).
If you sell your previous main home within 18 months, you can usually claim a refund of the ADS amount. Your solicitor will handle the paperwork and guide you through this process.
First-time buyers in Scotland benefit from an LBTT relief, meaning you don’t pay any tax on the first £175,000 of your property price.
If your new home costs more than that, you’ll only pay LBTT on the portion above £175,000 – not the full amount.
