Conduct and Competence Committee Hearings
At the hearing the committee will hear oral evidence and will conduct a four stage process as follows:
1. The committee will decide whether the facts of the allegations are proven. The onus of proof is on the NMC on the balance of probabilities;
2. The committee will then determine whether or not the conduct constitutes incompetence or misconduct;
3. Then they will consider whether the nurse or midwife’s Fitness to Practice is impaired;
4. Finally the committee will determine the appropriate sanction.
