Wills & Will Writing

Civil Partners and spouses have certain statutory rights known as earlier rights where no Will has been made. Living kids -which comprises adopted kids but excludes stepchildren- are entitled to legal rights whether a Will is in place or not. It is not the case as their entitlement is subject to an upper limit that married couples automatically receive the whole estate of their deceased spouse or civil partner. Scots Law now provides some help for single couples where their partner dies without making a will, however, they do not have an automatic right and any award is right at the discretion of the courts within strict timescales.
