Wills & Will Writing

Spouses and Civil Partners have certain statutory rights known as prior rights where no Will has been made. Surviving kids -which comprises adopted kids but excludes stepchildren- are eligible for legal rights not or whether a Will is in place. It is not the case that married couples automatically get the entire estate of their deceased spouse or civil partner as their entitlement is subject to an upper limit. Scots Law now provides some help for single couples where their partner dies without making a will, however, they do not have an automatic right and any award is right at the discretion of the courts within strict timescales.
