Wills & Will Writing

Spouses and Civil Partners have certain statutory rights known as earlier rights where no Will was made. Living kids -which includes adopted kids but excludes stepchildren- are entitled to legal rights not or whether a Will is in place. It is not the case as their entitlement is subject to an upper limit that married couples automatically get the entire estate of their deceased spouse or civil partner. Scots Law provides some help for single couples where their partner dies without making a will, nonetheless, they don’t have an automatic right and any award is right at the discretion of the courts within strict timescales.
