Family Law in Scotland

Oracle law are solicitors and solicitor advocates who specialise in family law including divorce and separation and child contact disputes.

The law of the family includes divorce and separation, financial provision for partners and children, the division and sale of family property and the care of and contact with children.

Family law in Scotland has developed enormously in recent years and continues to evolve to meet the needs of families in Scotland.  There is no such thing as a typical family: every family is unique and we recognise this in tailoring our advice and service to suit the circumstances each family finds itself in.

The breakdown of the family unit places everyone under enormous strain. There is no substitute for an experienced family solicitor who can explain the issues and deal with them quickly, effectively and discretely.

This family law section of our site is intended as an introduction to the subject.

Our section on Divorce covers the grounds upon which divorce can be based, the consequences of divorce and briefly considers some of the practical issues in obtaining a divorce.

Divorce often involves the redistribution of the family debts and assets and we consider this in the section on Financial Provision on Divorce.

Many parting couples find it is in their interests to agree the terms of their separation amicably. They often do this by entering into a binding agreement which can address the division of property and debts, responsibility for the care of children and other ancillary but important issues that may arise. We consider the advantages of a Minute of Agreement separately.

Often spouses and partners are subjected to violence, bullying and unpleasant behaviour. This important topic is dealt with under the heading of Matrimonial Interdicts.

The ongoing care of children is often the most pressing issue parties’ face when a family breaks up. The rights and responsibilities of parents and those persons who have to care for children are considered in our caring for children page.

The Child Support Act regulates the financial responsibility of absent parents toward their children. We give a general outline of how the Act provides for the support of children.
